This document is an electronic record in terms of the Information Technology Act, 2000 and rules there under as applicable. By accessing or using the SaveDish platform (savedish.in), you (“User”, “Organizer”, “Vendor”, or “Guest”) agree to be bound by these Terms & Conditions.

1. Definitions

  • “Company”, “We”, “Us”, “SaveDish”: Refers to the SaveDish platform and its administrative entity.
  • “Organizer”: The customer creating an event and booking vendor services.
  • “Vendor”: Independent service providers (Caterers, Decorators, etc.) registered on the platform.
  • “Guest”: Invitees who use the platform’s QR code system to digitally confirm their attendance.

2. Scope of Services & Limitation of Liability SaveDish primarily operates as a marketplace aggregator facilitating event bookings and our proprietary Digital Guest Confirmation system. While SaveDish may offer select in-house event or printing services, we do not directly prepare or execute services for third-party Vendors. SaveDish shall not be held liable for the exact execution, quality, or safety of the services rendered by independent third-party Vendors.

3. Disclaimer on Food Taste, Quality & Vendor Execution

  • No Guarantee on Food Taste: For bookings fulfilled by third-party Caterers, SaveDish explicitly disclaims any responsibility, warranty, or guarantee regarding the taste, quality, hygiene, or safety of the food provided at the event. All such culinary liabilities rest entirely with the selected Caterer.
  • Delays & Supply Shortages: SaveDish shall not be held liable for any operational deficiencies by independent Vendors, including late delivery of services, late arrival of food, or shortage in the promised quantity of items. Organizers must resolve these grievances directly with the respective Vendor.

4. Payment Terms, No Credit Policy & EMI (100% Upfront Payment)

  • Advance Payment: SaveDish operates on a strict 100% advance payment model. All event bookings require full payment at checkout. We do not offer direct credit facilities, partial payments, or “pay later” options.
  • Third-Party EMI: Customers requiring installment options may utilize EMI facilities provided by their respective Credit/Debit Cards or financial institutions via our payment gateway. Any such EMI arrangement is strictly a binding contract between the user and their issuing bank. SaveDish holds no liability for EMI approvals, interest rates, or subsequent banking disputes.

5. Vendor Onboarding, Commissions & Payouts SaveDish deducts a standard 5% platform commission (inclusive of gateway convenience fees) on all successful bookings. Payouts are processed via our internal dashboard post-commission deduction. Presently, no GST is levied on the commission as SaveDish operates under MSME and Trade License exemptions (subject to regulatory changes).

6. Technical Uptime, Glitches & Mandatory Manual Backup

  • While SaveDish utilizes robust technology, we do not guarantee 100% uninterrupted server uptime. SaveDish assumes no liability for event-day disruptions caused by server slowdowns, local internet failure, or device glitches.
  • Mandatory Backup Clause: As the guest list is locked exactly 24 hours prior to the event, Organizers are mandatorily required to download and print a physical copy of the “Locked Guest List.” This printed backup must be utilized to execute services if any technical failure occurs on the event day.

7. Legal Compliance & Zero Tolerance for Illegal Events SaveDish strictly complies with the laws of India and maintains a zero-tolerance policy towards illegal activities, explicitly including Child Marriage (prohibited under The Prohibition of Child Marriage Act, 2006).

  • SaveDish does not physically verify the ages of event participants. By generating an event QR code, the Organizer legally warrants that the event complies with all applicable laws.
  • Upon receiving verified reports of unlawful activities, SaveDish reserves the right to immediately terminate the event, block the QR code, and permanently ban the Organizer without refund, holding the Organizer entirely liable for all legal consequences.

8. Indemnification & Severability Users agree to indemnify and hold SaveDish harmless from any claims, damages, or legal fees arising from their misuse of the platform. If any provision of these Terms is deemed invalid by a court, the remaining provisions shall remain in full effect (Severability).

9. Governing Law & Jurisdiction These Terms shall be governed by the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the competent courts in West Bengal, India.
